For certain campaigns, cleaning or special offers, additional terms and conditions may apply. In case of any inconsistency between such terms and conditions and these Terms, those terms and conditions will prevail.

4. PURCHASES AND PAYMENTS

You will be responsible for payment of the applicable fees for any Services. You agree to pay all fees or charges to your Account in accordance with the fees, charges, and billing terms in effect at the time a fee or charge is due and payable. 

IN AUSTRALIA, OUR GOODS AND SERVICES COME WITH GUARANTEES THAT CANNOT BE EXCLUDED UNDER THE AUSTRALIAN CONSUMER LAW. NOTHING IN THESE TERMS AND CONDITIONS PURPORTS TO MODIFY OR EXCLUDE THE CONDITIONS, WARRANTIES AND UNDERTAKINGS, AND OTHER LEGAL RIGHTS, UNDER THE AUSTRALIAN COMPETITION AND CONSUMER ACT AND OTHER LAWS. 5. CHANGES AND CANCELLATIONS

You can cancel or amend a visit by contacting the team, free of charge, up to 48 hours before our visit is scheduled to begin. We are family focused and understand sometimes things pop up, however we appreciate your promptness in contacting us should you wish to cancel a booked service, If you cancel or amend a visit between 24 and 48 hours before the visit is scheduled to begin, you will have to pay cancellation costs equivalent to 50% of the visit fee. If you cancel or amend a visit within 24 hours before the visit is scheduled to begin, you will have to pay cancellation costs equivalent to the full cleaning fee.

6. PRICE CHANGES

SPRUCED Geelong reserves the right at any time to change its prices and billing methods, either immediately upon posting on the Business Properties, by text or email delivery to you, or any other reasonable means of communications.

7. LATE PAYMENT FEES

Failure to provide payment when due may incur late fees. 

8. KEYS

In order to provide certain services, SPRUCED Geelong will require access to your residence. SPRUCED Geelong takes reasonable measures to protect the security of all keys provided. EXCEPT AS OTHERWISE STATED HEREIN, EXCLUDING CASES OF GROSS NEGLIGENCE AND WILLFUL MISCONDUCT, THE BUSINESS HEREBY DISCLAIMS ALL WARRANTIES, RESPONSIBILITY AND LIABILITY ARISING FROM OR RELATED TO LOST KEYS, ANY UNAUTHORIZED USE OR ACCESS TO YOUR KEYS OR IMPROPER LOCKING OF RESIDENCES.

9. INTELLECTUAL PROPERTY RIGHTS

Unless otherwise indicated, we own or license from third parties all rights, title and interest (including copyright, designs, patents, trademarks and other intellectual property rights) in this website and in all of the material (including all text, graphics, logos, audio and software) made available on this website (Content).  Your use of this website and use of and access to any Content does not grant or transfer any rights, title or interest to you in relation to this website or the Content. Services Liability 

To the extent permitted by law, SPRUCED Geelong will not be responsible and will be excluded from all liability, for any loss or damage whatsoever (including personal injury, loss of life and damage to property) that you or another person may suffer in connection with the offer or supply of (or default in supplying) the services, including but not limited to any cleaning or other services.

13. DISPUTE RESOLUTION POLICY

SPRUCED Geelong will use reasonable endeavours to mediate any dispute concerning the use of the Website. Disputes in relation to the Cleaning Services carried out by a Business or any other issue will be referred, where appropriate, to external dispute resolution services or authorities. Any issues with the service must be reported to SPRUCED Geelong within 24 hours. You must provide us with photos of an unsatisfactory clean within 24 hours of completion.

14. JURISDICTION AND GOVERNING LAW

Your use of the website and these Terms are governed by the law of Victoria and you submit to the non-exclusive jurisdiction of the courts exercising jurisdiction in Victoria.

15. HOLIDAYS AND OTHER LEAVE

SPRUCED Geelong is committed to each and every client. From time to time throughout the year, your spruce may be cancelled due to annual leave, unexpected injury, illness or injury. Wherever possible, SPRUCED Geelong will work with any client impacted to ensure a make up spruce can be secured. Advance notice of at least one week is to be given to both parties.
